KEY WEST, FL – The Monroe County State Attorney’s Office has announced its intent to seek the death penalty against Michael John Demerjian, 36, of Big Pine Key, following his indictment for sexual battery on a child under 12, a capital felony under Florida Statute 794.011(2)(a).

A Monroe County Grand Jury returned the indictment, alleging that on or about October 10, 2024, Demerjian committed sexual battery against a child under 12. He was arrested shortly after the allegations came to light and has remained in custody without bond due to the severity of the charge.

Pursuant to Florida Rule of Criminal Procedure 3.181, the State Attorney’s Office has filed formal notice of its intent to seek the death penalty in this case. Prosecutors will present evidence to establish the following aggravating factors beyond a reasonable doubt: the victim was under 12 years old, and the defendant held a position of familial or custodial authority over the victim.

State Attorney Dennis Ward condemned the case as “vile and disgusting”, emphasizing the need for the strongest possible punishment. “The nature of this crime is beyond comprehension,” Ward said. “Crimes against children, especially those this egregious, demand the full force of the law, and we will not hesitate to seek justice.”

Chief Assistant State Attorney Joseph Mansfield reaffirmed the prosecution’s commitment to securing the maximum penalty. “The evidence in this case leaves no doubt about the necessity of seeking the death penalty,” Mansfield said. “We will aggressively prosecute this case to ensure justice is served.”

The prosecution will be led by Major Crimes Prosecutor Colleen Dunne, a seasoned trial attorney with extensive experience handling capital and serious felony cases.
