Florida Family in Court Friday Seeking Punitive Damages for Death Caused by Exploding Takata Airbag

Family of Patricia Mincey Also Trying to Force Takata Corporation C.E.O to Testify About Worldwide Effort to Conceal Critical Safety Information

NEW YORK – On Friday, July 15th at 10:00 a.m., a Florida Circuit Court will consider whether the family of Patricia Mincey, who suffered catastrophic injury when the airbag in her Honda Civic exploded in 2014, can ask a Florida jury for punitive damages.

Judge James Daniel will also decide whether Takata Corporation C.E.O will be required to testify in the case, which would be the first time the embattled company’s leader has been required to give sworn testimony since millions of vehicles were recalled in the wake of several deadly airbag explosions.

Ms. Mincey was paralyzed from the neck down in 2014 when the airbag in her 2001 Honda Civic forcefully exploded during a low-speed collision. She spent the next two years as a quadriplegic and passed away earlier this year due to complications from her quadriplegia. Four days after the original accident, the airbag in Ms. Mincey’s vehicle was recalled.

The Mincey family’s case is separate from the class action lawsuit currently pending against the Takata Corporation. However, this case has direct bearing on the class action, particularly in the event that Mr. Takada is ordered to testify. As the New York Times noted earlier this year, internal communications unsealed as part of this lawsuit shed “light on how much top executives in Tokyo knew and directed the company’s response to the mounting deaths and injuries.”
