Monroe State Attorney’s Office Announces Conviction and Sentencing in DUI and Hit-and-Run Case
The Monroe County State Attorney’s Office is pleased to announce the recent sentencing of Brian Gibbs following his no contest plea to multiple criminal and traffic charges.
Brian Gibbs was apprehended after he was observed driving a vehicle at a speed of 82 mph in a 45 mph zone, significantly over the legal limit. Law enforcement’s attention was drawn due to this excessive speed, and upon initiating a traffic stop, officers noted signs of impairment. It was later discovered that Gibbs was involved in a property-damaging hit-and-run at the Square Grouper restaurant before being stopped. His behavior escalated as he resisted arrest while being processed.
After pleading no contest, Brian Gibbs was adjudicated guilty on all charges and was sentenced for several offenses. He received six months of probation for leaving the scene of an accident involving damage. For driving under the influence with a prior conviction, he was sentenced to 24 months of probation, without early termination and required to enroll in DUI school, install an ignition interlock device on his vehicle for one year, have his vehicle impounded for 100 days, and undergo random drug tests for 24 months. In addition, Gibbs must perform 50 hours of community service for resisting an officer without violence. He also received a concurrent six-month probation for willfully refusing to sign and accept a summons.
Additional consequences included a one-year suspension of his driver’s license, a mandatory letter of apology, and court costs and fines totaling $1,668.00.
