Man arrested with loaded gun/one pound of marijuana candy edibles

A 23-year-old Broward County man was charged with possessing two handguns and a 28 packages of gummy marijuana candies.

Anthony Diaz of Miramar was charged with 28 counts of possessing a controlled substance, possession of marijuana with intent to sell, possession of marijuana and carrying a concealed firearm without a license.

Upper Keys Deputy Joel Rios was on patrol about 11 p.m. Monday on U.S. 1 at Mile Marker 83 when he spotted a black sport-utility-vehicle northbound pulling a boat trailer with no tag. Deputy Rios made a traffic stop. Deputy Rios detected a strong odor of marijuana coming from the SUV. Deputy Rios asked the driver, later identified as Diaz, if there were any weapons inside the SUV. Diaz said no. Sgt. Robert Dosh and Deputy Addison LaPradd arrived on scene.

Deputy Rios told Diaz he could smell marijuana. Diaz produced a plastic container containing what appeared to be a Ziploc bag containing loose-leaf, marijuana. Deputy Rios asked Diaz and the passenger to exit the vehicle. They obliged. Deputy Rios asked Diaz specifically if there were any guns in the SUV. Diaz stated there was. Diaz stated he did not have a concealed weapons permit.

Deputy Rios found a loaded 9mm handgun by the driver’s seat where Diaz had been sitting. The gun had previously been covered by Diaz’s shirt. A second gun, a 40-caliber handgun, was found in a bookbag on the floor behind the driver’s seat. Diaz stated the bookbag was his.

Also found were three, large Ziploc bags. The first bag contained 11 prepackaged, 300 milligram, gummy-candy bags labeled, “Deadhead.” The other two bags contained similar items with one bag containing nine gummy packages and the other had eight gummy packages. The total weight of the candies when removed from all the packaging was approximately one pound.

All field-tested positive for marijuana.

Diaz was taken to jail.
