Man arrested for battery on a law enforcement officer

A 47-year-old Key West man who threw himself into a moving vehicle on Stock Island was arrested Saturday afternoon.

Timothy Allen Smith, who was listed as homeless, was charged with battery on a law enforcement officer, disturbing the peace, resisting arrest with violence and resisting arrest without violence.

Deputies Shannon O’Connell and Jenna Moeller went to the 5500 block of MacDonald Avenue at 1:30 p.m. in reference to a suspicious person. There they found Smith close by waving a cardboard sign and yelling at passing motorists. He was also walking into traffic. The deputies attempted to talk to Smith, in an attempt to issue him a warning about possibly hitchhiking or panhandling. Smith walked away and attempted to ignore the deputies. He then began recording them with his phone, while yelling loudly and acting more aggressive.

When Deputy O’Connell attempted to detain him, he pulled away and ran down 3rd Street. He tripped, fell into a puddle, got up and began running again. He was ordered to stop to multiple times. Smith then ran into the street and threw himself into the driver’s side window of a vehicle traveling north on 3rd Street. That driver and another motorist stopped and provided witness statements. Smith again pulled away from deputies before he was finally taken into custody a short time later.

Deputy O’Connell suffered minor cuts and injuries. Smith was first taken to Lower Keys Medical Center after requesting medical attention.

He was then taken to jail.
