Man and woman arrested after flare gun incident

A 79-year-old Cudjoe Key man was arrested Friday night after shooting a flare gun multiple times at a victim attempting to serve civil process/legal papers. A 75-year-old female at the residence was also charged with resisting arrest.

William James Nash was charged with aggravated assault with a firearm and use of a firearm while under the influence of alcohol.

Carole Plumley Harwood was charged with resisting arrest and battery.

There were no injuries reported.

Deputies Brandon White, Jonathan Lane and Anthony Buscemi responded to the residence on the 200 block of Colson Drive at approximately 8:20 p.m. regarding a shots fired call. Deputy White arrived to find an irate woman, later identified as Harwood, yelling at a man who stated he and another female victim were both attempting to serve legal papers at the residence. Harwood continued to yell. The male victim stated she charged him and fell down prior to Deputies’ arrival. Harwood refused to follow orders and pulled away when Deputies attempted to detain her.

The male suspect, later identified as Nash, came down the stairs with his arms raised. He admitted to shooting at the male victim with a flare gun. He admitted to drinking earlier that night.

The female victim stated that she and her male colleague were attempting to serve the papers when Harwood met the male victim at the stairs and became combative. The male victim moved away back to his vehicle when Nash appeared on the balcony and shot a flare at both victims. The male process server then drew his legally concealed firearm and pointed it at Nash while telling him to cease firing. More flares were fired, each narrowly missing the male victim. One flare bounced off the hood of the victims’ vehicle.

The male victim did not fire his weapon during the incident. The male victim held Nash at gunpoint until Deputies arrived.

Deputy White viewed cell phone video footage of the incident recorded by the male victim. The video corroborated the victims’ version of events.

The residence still smelled of gunpowder. The flare gun and multiple empty flare casings were recovered by Deputies from the residence.

Nash and Harwood were taken to jail.
