Felon Caught with Handguns

An 18-year old Jacksonville man was arrested early Sunday morning on two felony weapons charges. A Key West Police Sergeant was stopped at a light downtown around 4 a.m. Sunday when he overhead two men discussing guns.

One asked “Is that a Glock?” and the suspect, Michael Theodore D’Agostio, answered that it was a .762 with a ten round clip.

The officer got out of his car and asked D’Agostio if he had a weapon and he said he did not. However the officer could see the weapon partially tucked into a pocket in the driver’s side door. Further investigation uncovered not only a .40 caliber Smith and Wesson, but a .38 revolver in the passenger side door pocket. Both guns were loaded. A background check revealed that D’Agostio is a convicted felon. It is illegal for convicted felons to carry firearms.

D’Agostio was transported to the Monroe County jail, where it was discovered that he had two pieces of ID belonging to two other men.

D’Agostio faces two felony charges of weapons possession by a felon, two felony counts of carrying counterfeit ID and one misdemeanor count of resisting without violence.
