Duval Street Cosmetic Store Cited, Refund Made

A Duval Street cosmetics shop has been cited for city code violations and one of two women visitors that claim they were “ripped off” by the business have received a full refund.
 
Francesca, a cosmetics store at 119 Duval Street, Key West, has been cited by the city code compliance office for violating a statute that requires patrons be told prices of products before they are applied.
 
The charges stem from an April 26, 2016 visit to the store by Judy Nye, 70, of South Bend Indiana and Barbara Kabzinski, 79, from Spring Hills, Florida. Both women claim store employees applied cosmetics before disclosing the prices in violation of city code.
 
Judy Nye said the company charged her credit card for two purchases totaling $958.90, then failed to send her the products as promised. Nye`s friend ,Barbara Kabzinski ,was unable to return unused products totaling $270.90 under the stores stated return policy.
 
The Key West Rip Off Rapid Response Team, a local consumer advocacy group, that has picketed local cosmetics stores in the past, demanded the store refund both women their money in a letter dated June 29, 2016. The letter stated “Failure to refund these two women their money will force us to take further action. Make it easy on yourselves. Refund their money now.”
 
On July 5, Judy Nye received two checks from the business totaling $958.90, the total amount of her purchase. Barbara Kabzinski is still waiting for her refund.
 
A code hearing on the charges against Francesca has been set for July 27, 2016.
