Deputy Cody Jackson and Sgt. Paul Bean responded to the 30 block of  Southeast Marlin Avenue in Key Largo about 7 p.m. regarding a battery whereupon they found the owner of the residence and four construction workers. The owner of the resident stated he hired one of the men to install tile in his home. That man then hired the others to help do the job. The owner stated that when the job was complete a rumpus ensued among some of the men he hired as to who was to be paid what. The owner stated he attempted to intervene in the “shouting match” when one of the men, later identified as Banegas-Martel, throw a pair of garden sheers at one of the other workers.

Paramedics stated the victim suffered cuts to his hand and chest, some of which would require sutures to close.

Sgt. Bean located Banegas-Martel not far from the residence and brought him back to the scene. Banegas-Martel admitted to grabbing the garden sheers at some point during the tumult.

The garden sheers were found and placed into evidence.
