A Key West man given a break in sentencing for a past residential burglary received no such break during sentencing for his latest offenses
KEY WEST, January 4, 2020 – On December 20, Monroe County Judge Mark Wilson sentenced Lavon Gunn, 33, to 36 months in state prison after Gunn pleaded no contest to possession of a controlled substance. He also admitted to violating, again, terms of his probation imposed in the burglary by getting arrested for the drugs and received a concurrent 36 months in custody. Assistant State Attorney Patrick Flanigan represented the state.
Gunn’s latest arrest happened this past June 22, when a Monroe County Sheriff’s Office deputy pulled over a car in which he was a passenger. A Key West police officer with a K-9 arrived to assist, and the dog alerted to the presence of drugs in the car. Police found marijuana “shake” on the front floorboards of the car so they searched the occupants. They found .02 grams of methamphetamine wrapped in currency in one of Gunn’s socks.
Monroe County Circuit Court Judge Timothy Koenig imposed Gunn’s original probation, 36 months with drug treatment, on October 31, 2017, when Gunn pleaded no contest to burglary of a structure, grand theft and criminal mischief.
A Windsor Lane resident had called city police to report his house, into which he had just moved, was burglarized April 4, 2016. Two televisions worth a combined $1,300, plus a bottle of liquor, were taken. The lock on a side door had estimated damage of $200. Police were able to lift fingerprints from another television and a computer check revealed they matched Gunn’s. He was arrested December 7 that year.
The November after being sentenced, Gunn refused to take a drug test where he was being treated. Then that December, he tested positive for cocaine. In July 2018, he had probation reinstated and extended for six months, and was ordered into residential drug treatment. Then came his 2019 drug arrest.
