LETTER TO THE EDITOR / IT’S NOT THE CRIME, IT’S THE COVER-UP

Roger C. Kostmayer

The Senate’s Kavanaugh advice and consent process isn’t about SEX ( though he is accused of sexual assault, attempted rape, exposing himself and of witnessing gang rape), nor is it about being Drunk and Disorderly (though several college acquaintances, and a police report, accused Kavanaugh of such incidents).

This inquiry is now about three issues: Lies, Judicial Temperament and Partisan political conspiracy rants. Any one of these serious concerns could, and should, be grounds for disqualification of a Supreme Court nominee. If this sounds harsh or like a standard too high, recall a 41 year old SC nominee, Douglas Ginsburg, who in 1987 was forced to withdraw his nomination because NPR’s Nina Tottenberg reported he had smoked a joint on several occasions before he was a judge.

A Supreme Court Justice, with the absolute power to judge others, must be above the partisan fray and have the highest integrity, truthfulness and impartial judicial temperament. It’s imperative that the court and the justices maintain the trust and respect of all who appear before them as well as the American people. If they don’t, our three branch democracy won’t survive.
